Terms and Conditions

These Terms of Service apply to purchases from and use of DrugTestKits.ca, operated by Drug Test Kits in Barrie, Ontario, Canada. “We”, “us” and “our” mean Drug Test Kits. Please read these terms, our Privacy Policy and our Return and Refund Policy before ordering. You can save or print these terms for your records.

1. Your agreement and legal rights

When placing an order, you agree to the terms disclosed for that purchase. You must have legal capacity to enter into the transaction or act with appropriate authorization. If you order for an organization, you must have authority to act for it.

Nothing in these terms removes a right or remedy that cannot lawfully be waived. Applicable protections under Ontario’s Consumer Protection Act, 2002, the Sale of Goods Act and other applicable laws take priority over any conflicting wording. Mandatory protections in another jurisdiction remain available where they apply. Consumer protections may differ for purchases made for business purposes.

2. Product selection and intended use

Check the product description, intended use, drug panel, cutoff levels, pack size and quantity before ordering. Photographs may show representative packaging; the specific description and configuration identify what you are buying. A photograph does not expand a product’s stated capabilities. Contact us before buying if any detail is unclear.

Use products only for their stated purpose and follow the manufacturer’s instructions, storage requirements, expiry dates and reading times. Where an oral fluid or saliva test is labelled “For informational use and purpose only.”, that restriction applies. A screening result alone does not establish impairment, a diagnosis or fitness for work or driving. Obtain appropriate professional advice and confirmatory testing where required. Website information does not replace medical, legal or occupational-health advice.

If you test another person or arrange testing for an organization, you are responsible for obtaining the necessary consent or other lawful authority and complying with applicable privacy, employment, human-rights and testing requirements. Buying a kit does not authorize testing or disclosure of another person’s results.

3. Orders, prices and payment

Prices are in Canadian dollars unless expressly stated otherwise. Applicable taxes, shipping and other disclosed charges are shown before you complete checkout. We collect applicable GST/HST and other taxes as required by law. Discounts apply only when their stated eligibility and quantity requirements are met.

Provide accurate contact, billing and delivery details, and review and correct your order before submitting it. Payment methods offered at checkout, or separately agreed with us in writing, apply. Keep your order confirmation and contact us if you do not receive it.

We may decline an order before acceptance for reasons such as unavailable stock, an inability to verify payment, suspected fraud or an obvious listing error, subject to applicable law. We will notify you if an issue prevents us from supplying your order. We will not charge an increased price or substitute a materially different item without your agreement. If we cancel or cannot supply an item, we will refund the amount paid for it and associated amounts required by law. This does not limit rights arising from an accepted order or misleading information.

4. Delivery

Delivery options and charges are provided at checkout. See our Shipping Information for processing and delivery details. Transit estimates are not guarantees unless expressly stated, but they do not remove statutory rights concerning late delivery or non-delivery. We will advise you of availability issues affecting your order.

Contact us promptly about missing, damaged or incorrectly supplied goods so we can investigate and arrange the appropriate remedy. Optional shipping insurance does not remove our legal obligations or make statutory remedies conditional on buying insurance. Any contrary wording in shipping information is subject to this protection.

5. Final sales, returns and defective items

We do not accept change-of-mind returns or provide discretionary refunds, exchanges or store credit, including for unused, unopened or sealed products. This includes customer selection errors, incorrect quantities and duplicate orders, unless our error, a misleading description or applicable law gives you a right to a remedy. We do not offer discretionary change-of-mind cancellations before dispatch.

We cannot resell returned testing products because their storage and handling history cannot be verified, even when packaging is unopened. Our standard remedy for a confirmed defective item is replacement only. If we supplied damaged, incorrect or misdescribed goods, contact us so we can correct the problem. Where applicable law or an express written warranty requires a refund or another remedy, we will provide it.

Our Return and Refund Policy explains the assessment process and safe return instructions. Contact us as soon as reasonably possible with your order number and details of the issue. Do not mail used devices, specimens or contaminated materials through ordinary mail. A Return Merchandise Authorization is an administrative reference, not a condition of giving a valid statutory cancellation notice or exercising another legal right.

6. Statutory cancellation and refunds

Depending on the transaction and circumstances, the law may provide cancellation, refund or other remedies for matters such as unfair or misleading practices, defective or misdescribed goods, qualifying late or non-delivery, or failure to provide required online-agreement information or a compliant agreement copy. The conditions and time limits for the particular right apply. There is no blanket 14-day-from-purchase limit on statutory claims.

Where a refund is legally required, we will provide it within the required time and include all amounts required by law. We will not substitute store credit for a required refund or deduct prohibited fees. Responsibility for any return costs is determined by applicable law. Contact us using the details below; nothing here restricts a legally valid method of giving notice.

7. Training and testing services

For training, laboratory or other services, review the listing and any service-specific terms disclosed before purchase, including what is included, provider identity, access requirements and completion requirements. Training products are services rather than stocked physical kits. A course purchase alone does not guarantee certification, qualification for every workplace or a particular outcome.

Service-specific cancellation or scheduling conditions apply only as disclosed and permitted by law. Nothing in the final-sale policy removes rights concerning services that are not supplied or are not provided as agreed. Where a service involves personal information, specimens or results, the relevant consent, reporting and provider arrangements must be explained for that service.

8. Privacy, cookies and communications

Our Privacy Policy explains how we handle order information, website activity and information needed for purchased testing services, including test results where relevant. It also explains Shopify and other providers, processing outside Canada, retention, access requests, cookies, analytics and advertising choices.

Using this website or accepting these terms does not provide blanket consent to optional tracking, marketing or advertising uses of sensitive information. Appropriate consent or other lawful authority is required. A purchase by an employer or another person does not authorize unrestricted disclosure of results.

Marketing communications are subject to applicable consent and unsubscribe requirements. You may unsubscribe without losing access to necessary order or service communications. Do not send test results, medical records or other sensitive information through ordinary email or our general contact form unless we have confirmed an appropriate submission method.

9. Accounts and acceptable use

Keep account credentials secure and notify us of suspected unauthorized access. Do not use the website for fraud, unlawful activity, harassment, malicious software or attempts to bypass security. We may restrict access reasonably necessary to protect the store or others. Such action does not remove obligations relating to existing orders, refunds or personal information.

10. Website content and third parties

We or our licensors own the website content and branding. You may view, save and print information for lawful shopping, product use and recordkeeping. Other reproduction or commercial reuse requires permission unless allowed by law. You may link to our pages without implying an endorsement or misrepresenting our business.

Reviews or other content you submit must be truthful, lawful and respect others’ rights and privacy. If you submit a review for publication, you permit us to display and format it for that purpose without changing its meaning. Do not include test results or another person’s sensitive information in public reviews.

Independent websites and service providers may have their own terms. Review those before using their services. A third-party link does not remove our responsibilities for products or services we sell or information under our control.

11. Responsibility and warranties

We aim to keep information accurate and the website available, but interruptions and errors may occur. Contact us about an error so we can address it. We do not guarantee uninterrupted website access or a particular testing outcome.

These terms do not disclaim mandatory warranties, required standards of quality or fitness, or our responsibility for goods and services as described. We do not exclude liability for fraud, wilful misconduct or any liability that cannot lawfully be excluded. Each party remains responsible to the extent provided by applicable law.

12. Ontario law and resolving concerns

These terms are governed by Ontario law and the applicable federal laws of Canada, subject to mandatory protections that apply elsewhere. Please contact us first so we can try to resolve a concern. Doing so is not a prerequisite to exercising a legal right. Nothing requires mandatory arbitration, waives a lawful class proceeding or prevents you from using a court, tribunal, regulator or complaint process available under applicable law.

13. Updates and existing purchases

This version applies to new orders placed on or after the update date. Changes do not retroactively remove rights or promises attached to an earlier purchase. We will identify updated terms on this page and obtain any further agreement required by law. If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law.
